7. Products choice
The Buyer having taken knowledge of the products marketed by the Seller has, under his sole responsibility and according to his needs as he has previously determined before any order, made his choice on the product or products subject of his command. The Buyer knowing only the products he owns and uses is the sole judge of the compatibility of the products ordered with those used by him.
It is the sole responsibility of the Purchaser, if he does not consider himself competent enough, to be assisted by counsel.
8. Delivery and reception
The products are delivered to the address indicated by the Buyer when ordering. Once the order is validated and shipped, the Buyer can ask for any invoice by contacting us by email: ineedinfo@favourite-design.com
Failure to comply with the procedures set out below, no claim of the Buyer will be accepted.
Order processing is from Monday to Friday inclusive, subject to availability of products. Orders received on Saturday and Sunday are dispatched the following week. Orders received on public holidays in France are dispatched on the following working days.
When placing an order, the Buyer provides under its sole responsibility the following information:

– Last name and first name
– Address (street number) and building (number)
– City
– Postal code
– Phone
In case of error in the address details of the recipient, the Seller can not be held responsible for the impossibility of delivery. In this case, as in case of cancellation of the order by the Buyer after shipment, shipping costs will not be refunded to the customer by the Seller.
The data recorded by the computer system www.favourite-design.com constitute proof of all transactions between the Seller and its customers. Any delay in delivery gives right to damages from the seller if the delay is more than 60 days late.
The reception of the transported objects extinguishes any action against the valet for damage or partial loss if within three days, not including the holidays, which follows that of this reception, the addressee did not notify the valet, by extrajudicial act or by registered letter, his reasoned protest.
If, within the above-mentioned period, a request for an expert is made pursuant to Article L. 133-4, this request is a protest without it being necessary to proceed as described in the first paragraph.
All contrary stipulations are null and void. This last provision is not applicable to international transport.
When the consumer personally takes delivery of the transported objects and when the valet does not justify giving him the opportunity to verify effectively their good condition, the period mentioned in Article L. 133-3 of the Commercial Code is increased to ten days.
Any order placed on the website www.favourite-design.com and delivered outside France may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and any taxes, related to the delivery of an article, are at your expense and are your responsibility. We are not required to verify and inform you of applicable customs duties and taxes. To know them, we advise you to inquire with the competent authorities of your country.
If the repeated absence of the customer at the time of the delivery involves a return of the products at the Seller, the expenses of return and ancillary expenses are with the load of the customer.
9. Right to retract
In accordance with Article L.121-20 of the Consumer Code, the Purchaser has a period of fourteen clear days from the date of receipt, to return at its expense products ordered for refund.
The products must be returned to the Seller in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed. The withdrawal form will be attached with the invoice when sending the goods
10. Retention of title
The Seller retains full ownership of the products sold until full payment of the price, principal, fees and taxes included.
11. Responsibility
The Seller can not be held responsible for the non-performance of the contract in case of out of stock or unavailability of the product due to a case of force majeure, disruption or total or partial strike including postal services and means of transport and / or communications.
The Seller can not be held responsible for any indirect damage that may occur due to the purchase of products.
Seller can not be responsible for any loss of data or files. It is the Buyer’s responsibility to make all necessary backups.
The site www.favourite-design.com contains information from third parties, and links to other websites. Seller shall not be held liable for any damages resulting from the use, access or inability to use such third party information or the content of other websites.
12. Partial validity
If one or more stipulations of the present general conditions of sale are held for invalid or declared as such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their strength and reach.
13. No waiver
The fact for one of the parties not to claim a breach with the other party to any of the obligations referred within these terms and conditions of sale can not be interpreted for the future as a waiver the obligation in question.
14. Law enforcement
Sales of products are subject to French law. Any dispute relating to the interpretation, performance or breach of the contract concluded between the Seller and the Buyer, even in the event of multiple defendants, will, in the absence of amicable agreement, be the exclusive jurisdiction of the courts.
15. Information and freedom
The information collected by the Seller during any order from the Buyer is necessary for the management of his order by www.favourite-design.com and its commercial partners. 16. Guarantees
The legal guarantee of conformity of the property to the contract is governed by articles L. 211-1 to L. 211-14 of the code of consumption.
The legal guarantee against latent defects is governed by articles 1641 to 1649 of the Civil Code.
